MEFERI Technologies Co., Ltd. and its affiliates (collectively, “MEFERI”, “we”, “us”, or “our”) are committed to protecting your privacy. This Privacy Policy (“Policy”) explains how we collect, use, disclose, and safeguard your Personal Information when you visit our websites (including, but not limited to, meferi.com, form.meferi.com, portal.meferi.com, support.meferi.com, and any other MEFERI-owned websites that link to this Policy) (collectively, the “Sites”), use our services provided through the Sites, or otherwise interact with us where MEFERI acts as a Data Controller.

This Policy does not apply where MEFERI processes Personal Information on behalf of our Customers as a Data Processor (e.g., in the provision of MEFERI Shadowalk MDM/EMM Cloud Solution or cloud-hosted components of the CIAO Intelligent Shopper Assistant). Such processing is governed by our Data Processing Agreement (DPA), available here

Company Information (when acting on behalf of a company): Name, registration numbers, addresses, phone and fax numbers, website, bank details, name of chief executive. Please note that information about a legal entity itself is not Personal Information but may be linked to the Personal Information of a contact person.

Law Enforcement, Regulatory Bodies, Government Agencies, Courts or other Third Parties: If we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person.

Potential Buyers (and their agents and advisers): In connection with any proposed or actual purchase, merger, or acquisition of any part of our business, provided that we inform the buyer it must use your Personal Information only for the purposes disclosed in this Privacy Policy.

With Your Consent: To any other third party with your prior consent.

7. International Data Transfers

Your Personal Information may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different from the laws of your country.

Specifically, our Site servers may be located in various jurisdictions (e.g., in the EEA via AWS, as outlined in our Sub-processor List for our site infrastructure), and our parent company is in China. Our third-party service providers and partners also operate globally. This means that when we collect your Personal Information, we may process it in any of these countries.

Where we transfer your Personal Information from the EEA/UK to countries outside of them that have not been determined by the European Commission to provide an adequate level of data protection, we take appropriate steps to ensure that your Personal Information is protected in accordance with this Policy and applicable data protection law. These measures include using the European Commission’s Standard Contractual Clauses for transfers of Personal Information among our group companies and with our third-party service providers, or relying on other lawful transfer mechanisms. The role of our EU Representative also facilitates compliance.

8. Data Security

We have implemented appropriate technical and organizational security measures designed to protect the Personal Information we process. These measures are designed to provide a level of security appropriate to the risk of processing your Personal Information. However, please remember that no method of transmission over the Internet, or method of electronic storage is 100% secure.

9. Data Retention

We retain Personal Information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax, or accounting requirements).

When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

If you are a resident of the European Economic Area (EEA) or the UK, you have the following data protection rights:

Right of Access: You have the right to request access to your Personal Information that we hold.

Right to Rectification: You have the right to request correction of any inaccurate or incomplete Personal Information about you.

Right to Erasure (‘Right to be Forgotten’): You have the right to request the deletion of your Personal Information under certain circumstances.

Right to Restrict Processing: You have the right to request the restriction of processing of your Personal Information under certain circumstances.

Right to Data Portability: You have the right to receive the Personal Information you have provided to us in a structured, commonly used, and machine-readable format, and have the right to transmit those data to another controller under certain circumstances.

Right to Object to Processing: You have the right to object to the processing of your Personal Information under certain circumstances, particularly where we process your data based on legitimate interests or for direct marketing purposes.

Right to Withdraw Consent: If we are collecting and processing your Personal Information with your consent, you have the right to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

11. Children’s Privacy

Our Sites are not intended for children under the age of 16, and we do not knowingly collect Personal Information from children under 16. If you are under 16, please do not use or provide any information on these Sites. If we learn we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us.

12. Links to Other Websites

Our Sites may contain links to other websites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
